By accessing or using Dibma (the "Service"), you signify that you have read, understood, and agree to be bound by this Legal Disclaimer and Terms of Use (the "Terms"). If you do not agree to these Terms, you may not use the Service.

2. Service "As Is" and "As Available"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Dibma does not warrant that the Service will be uninterrupted, secure, or error-free, nor does it warrant that any defects will be corrected.

3. Intended Purpose & User Responsibility

Dibma is designed to generate synthetic route data in standard file formats (e.g., .GPX) for personal, entertainment, or educational purposes, such as understanding GPS data structures or testing applications that process such data.

• You, the user, are solely responsible for your use of any data generated by the Service ("Generated Data").
• You must comply with all applicable laws, regulations, and the terms of service of any third-party platforms (e.g., fitness tracking applications, social media sites) with which you may choose to use the Generated Data.
• You understand and assume all risks associated with the use of Generated Data, including but not limited to the potential for account suspension, termination, or other penalties from third-party platforms.

4. No Guarantee of Acceptance or Accuracy

Dibma makes no guarantees, representations, or warranties that Generated Data will be accepted, processed, or accurately displayed by any third-party platform. The compatibility and interpretation of Generated Data are solely at the discretion of such third-party platforms.

5. Limitation of Liability

To the fullest extent permitted by applicable law, Dibma, its owners, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on or related to the Service;
• Any Generated Data obtained from the Service; or
• Unauthorized access, use, or alteration of your transmissions or content, including any consequences arising from the upload or use of Generated Data on third-party platforms (such as account suspension or termination).

6. Indemnification

You agree to defend, indemnify, and hold harmless Dibma, its owners, operators, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney`s fees) arising from:

• Your use of and access to the Service, including any Generated Data you create, use, or distribute;
• Your violation of any term of these Terms;
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right, or the terms of service of any third-party platform.

7. No Endorsement or Affiliation

Dibma is an independent service and is not affiliated with, endorsed by, or sponsored by Strava, Garmin, Nike, or any other fitness tracking platform or third-party service. All trademarks, service marks, trade names, and logos mentioned on the Service are the property of their respective owners.

8. Modification of Terms

Dibma reserves the right, at its sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

9. Refund Policy

There is no refund for any payments made. However, if you have already paid and are unable to generate the GPX file, please contact us at help@dibma.com for assistance.
