1. Acceptance of Terms

By accessing or using Dibma, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

2. Service Description

Dibma provides a platform for generating synthetic route data in standard file formats (e.g., FIT, GPX, TCX). The Service is intended for:

• Personal, entertainment, or educational purposes
• Understanding GPS data structures and formats
• Testing applications that process fitness data
• Creating custom route files for personal use

3. User Accounts

Account Creation

To access certain features of the Service, you may need to create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. You may also delete your account at any time through your account settings.

4. User Responsibilities

When using the Service, you agree to:

• Comply with all applicable laws, regulations, and these Terms
• Comply with the terms of service of any third-party platforms where you may use Generated Data
• Understand and assume all risks associated with using Generated Data, including potential account suspension or termination from third-party platforms
• Not use the Service for any illegal, fraudulent, or harmful purposes
• Not attempt to interfere with, compromise, or disrupt the Service
• Not reverse engineer, decompile, or attempt to extract the source code of the Service

5. Credits and Payments

Credit System

Dibma operates on a credit-based system. Credits are required to generate files and access certain features. Credits are:

• Non-transferable between accounts
• Non-refundable once purchased (except as stated in our Refund Policy)
• Subject to expiration as specified at the time of purchase

Pricing

All prices are displayed in Indonesian Rupiah (IDR) unless otherwise stated. We reserve the right to modify pricing at any time. Price changes will not affect credits already purchased.

6. Intellectual Property

Our Rights

The Service, including its original content, features, and functionality, is owned by Dibma and is protected by international copyright, trademark, and other intellectual property laws.

Your Rights

You retain ownership of any content you create using the Service. However, by using the Service, you grant us a limited license to store and process your data as necessary to provide the Service.

Third-Party Trademarks

Dibma is an independent service and is not affiliated with, endorsed by, or sponsored by Strava, Garmin, Nike, Wahoo, or any other fitness tracking platform or third-party service. All trademarks, service marks, trade names, and logos mentioned on the Service are the property of their respective owners.

7. Disclaimer of Warranties

To the maximum extent permitted by applicable law, we expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties that defects will be corrected
• Warranties that Generated Data will be accepted or accurately processed by any third-party platform

8. Limitation of Liability

To the fullest extent permitted by applicable law, Dibma, its owners, operators, employees, and affiliates shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenues, data, use, goodwill, or other intangible losses
• Damages resulting from your access to, use of, or inability to use the Service
• Damages resulting from any conduct or content of any third party
• Damages resulting from Generated Data, including consequences arising from uploading or using Generated Data on third-party platforms (such as account suspension or termination)
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability exceed the amount you have paid to us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Dibma, its owners, operators, employees, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from:

• Your use of and access to the Service
• Any Generated Data you create, use, or distribute
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights or terms of service of any third-party platform
• Any claim that your use of the Service caused damage to a third party

10. Modifications to Service and Terms

Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

Terms Modifications

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Effective Date" at the top. Your continued use of the Service after any changes indicates your acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Indonesia.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
